Terms of service

These Terms of Service govern access to and use of rothysyx.shop and purchases made through the website.

Throughout these Terms, “we,” “us,” “our” and “rothysyx.shop” refer to the operator of rothysyx.shop in connection with the website and online retail services.

Customer-service enquiries may be sent to:

info@rothysyx.shop

By accessing our website or placing an order, you agree to these Terms to the extent legally enforceable.

Nothing in these Terms excludes or restricts mandatory rights available to consumers under French or European Union law.

1. Online Store

rothysyx.shop provides an ecommerce platform through which customers may browse, select and purchase available products.

The website uses Shopify ecommerce technology and may rely on third-party providers for payment processing, technical infrastructure, fraud prevention, fulfilment, shipping and related services.

2. Eligibility

By placing an order, you confirm that you have the legal capacity required to enter into the transaction or are otherwise legally authorised to make the purchase.

You must provide accurate and sufficiently complete checkout information.

3. Product Information

We endeavour to describe products accurately.

However, reasonable differences may occur between website images and physical products due to screen displays, lighting, photography, production variations or other technical factors.

Product descriptions, prices, specifications and availability may be corrected or updated where appropriate.

Nothing in this clause affects statutory rights relating to misdescribed or non-conforming products.

4. Prices

The price applicable to an order is ordinarily the price displayed when the customer submits the order.

Any taxes or charges required to be disclosed or collected will be handled through the applicable checkout process.

We may prospectively change prices without notice.

Obvious technical or pricing errors may be corrected to the extent permitted by applicable law.

5. Orders

Submitting an order constitutes an offer to purchase the selected products under the terms displayed at checkout and these Terms.

An automated email acknowledging receipt does not necessarily mean that payment, inventory and fraud-prevention checks have been completed.

We may decline or cancel an order where reasonably necessary, including in cases involving:

  • Product unavailability;
  • Payment failure;
  • Suspected fraud;
  • Material pricing errors;
  • Incorrect product information;
  • Legal restrictions; or
  • Inability to fulfil the order.

Where an amount has been paid for an order that is lawfully cancelled by us, the relevant amount will be refunded as required.

6. Payments

Available payment methods are displayed at checkout.

By providing payment information, you represent that you are authorised to use the selected payment method.

Payment transactions may be processed by independent payment-service providers.

7. Shipping

All orders qualify for free standard shipping.

Our standard estimated delivery timeframe is 15–20 calendar days.

Further information is provided in our Shipping Policy.

The seller must comply with applicable French rules concerning agreed delivery periods and consumer remedies for qualifying delays.

8. Transfer of Risk and Delivery

Products will be delivered in accordance with applicable consumer rules.

Where mandatory French consumer law determines when risk transfers from the professional seller to the consumer, those mandatory rules prevail over any inconsistent provision in these Terms.

9. Right of Withdrawal

Qualifying consumers purchasing goods at a distance generally have at least 14 calendar days following receipt of goods to exercise the statutory right of withdrawal, subject to statutory exceptions.

The detailed procedure is described in our Return & Refund Policy.

10. Returns and Refunds

Returns and refunds are governed by our Return & Refund Policy together with mandatory consumer law.

Nothing in a voluntary store return rule limits statutory rights relating to withdrawal, non-conformity or hidden defects.

11. Legal Guarantee of Conformity

Consumers purchasing qualifying goods from a professional seller benefit from mandatory protections under French law.

The legal guarantee of conformity generally applies for two years under the applicable conditions.

The professional seller remains responsible to the consumer for that statutory guarantee and cannot avoid mandatory obligations merely by directing the consumer to a manufacturer.

12. Hidden Defects

Applicable rights relating to hidden defects under French law are unaffected by these Terms.

Where statutory conditions are satisfied, those rights apply independently of any commercial warranty or voluntary store policy.

13. Intellectual Property

Unless otherwise indicated, content made available through rothysyx.shop, including website text, graphics, layouts, design elements and original store materials, may be protected by intellectual-property rights.

You may use the website for lawful personal shopping purposes.

You may not unlawfully reproduce, exploit, distribute or commercially use protected content without appropriate authorisation.

14. Prohibited Uses

You must not use rothysyx.shop:

  • For unlawful purposes;
  • To commit fraud;
  • To transmit malicious software;
  • To interfere with website security;
  • To gain unauthorised access to systems;
  • To impersonate another person;
  • To misuse payment systems;
  • To scrape or extract protected content unlawfully; or
  • To infringe the rights of another person.

15. Accounts

If customer accounts are available, customers are responsible for maintaining the confidentiality of their login credentials.

You should contact us if you reasonably believe your account has been compromised.

16. Third-Party Services

The website may rely on or link to third-party services.

Independent third parties may apply their own terms and privacy policies to services they directly provide.

Nothing in this clause permits us to avoid responsibilities that mandatory consumer law places on the seller.

17. Website Availability

We aim to maintain reasonable website availability but do not guarantee uninterrupted operation.

Temporary interruption may occur for maintenance, security, technical failures, infrastructure problems or circumstances outside reasonable control.

18. Disclaimer

To the maximum extent permitted by applicable law, information provided on the website is made available for ordinary ecommerce purposes and does not constitute professional, medical, financial or legal advice.

Any disclaimer is subject to mandatory consumer law.

19. Limitation of Liability

Nothing in these Terms excludes liability where exclusion or limitation is prohibited by applicable law.

In particular, these Terms do not exclude statutory consumer remedies or liability that cannot legally be waived.

For matters where liability can lawfully be limited, any limitation will apply only to the extent permitted by applicable law.

20. Force Majeure

We will not be responsible for delay or failure to perform where and to the extent performance is prevented by an event legally constituting force majeure or another circumstance for which liability is excluded under applicable mandatory law.

Consumer remedies that remain mandatory in such circumstances are unaffected.

21. Personal Data

Personal information is handled in accordance with our Privacy Policy and applicable data-protection law.

22. Consumer Complaints

Customers should first contact us regarding an order or dispute at:

info@rothysyx.shop

We will make reasonable efforts to examine customer complaints and seek an appropriate resolution.

23. Consumer Mediation

French professionals must provide consumers with access to an approved consumer-mediation mechanism and publish information identifying the mediator actually appointed by the business.

The identity of the competent appointed mediator must correspond to the business's genuine mediation arrangement and cannot properly be invented in these Terms.

24. Governing Law

These Terms are governed by applicable law, including mandatory French and European Union consumer protections where they apply.

A choice-of-law clause does not deprive consumers of mandatory protections granted to them by law.

25. Severability

If a provision of these Terms is found invalid or unenforceable, the remaining provisions will continue to apply to the extent legally possible.

26. No Waiver

Failure to enforce a contractual provision immediately does not necessarily constitute a permanent waiver of that provision or any applicable legal right.

27. Changes

We may update these Terms prospectively to reflect legal, operational or technical changes.

The version applicable to an order will be determined in accordance with applicable contract law.
